18 U.S.C. 2257 Compliance

I. Statement of Compliance

Any human being that appears in any visual depiction of actual or simulated sexually explicit conduct appearing or otherwise contained on Fansxity (hereinafter referred to as the “Platform”) was at least eighteen (18) years of age when those visual depictions were produced.

All models, actors, actresses, performers, and other persons that appear in any visual depiction of actual or simulated sexually explicit conduct appearing on, or otherwise contained in, this Platform were required to be over the age of eighteen (18) years at the time the visual image was produced.

II. Legal Authority and Scope

This Compliance Statement is issued pursuant to:

Title 18, United States Code, Section 2257 (18 U.S.C. § 2257) — Record-keeping requirements for producers of visual depictions of actual sexually explicit conduct
Title 18, United States Code, Section 2257A (18 U.S.C. § 2257A) — Record-keeping requirements for producers of visual depictions of simulated sexually explicit conduct
Title 28, Code of Federal Regulations, Part 75 (28 C.F.R. Part 75) — Regulations implementing the record-keeping requirements

The federal record-keeping requirements under 18 U.S.C. § 2257 apply specifically to visual depictions of actual human beings engaged in sexually explicit conduct, as defined in 18 U.S.C. § 2256(2)(A).

III. Custodian of Records

Records required for all depictions of actual sexually explicit conduct by Title 18 U.S.C. § 2257 and its related regulations, and records required for all depictions of simulated sexually explicit conduct by Title 18 U.S.C. § 2257A and its related regulations, are on file with the Custodian of Records set forth below and will be made available to authorized inspectors.

IV. Exemptions from Requirements

To the extent that any images or videos appear on the Platform for which the operator of the Platform may be considered the “producer,” those images and videos are exempt from the requirements of 18 U.S.C. §§ 2257–2257A and 28 C.F.R. Part 75 for one or more of the following reasons:

(3) Post-Effective Date Simulated Activity	Does not portray simulated sexually explicit activity occurring after effective date of 18 U.S.C. § 2257A
(4) Pre-1995 Content	Visual depictions created before July 3, 1995
(5) Third-Party Content	Platform operator is not “producer” — only transmits, stores, hosts third-party user content

All other visual depictions displayed on the Platform are exempt from the provisions of 18 U.S.C. §§ 2257, 2257A, and/or 28 C.F.R. Part 75 because they do not portray conduct as specifically listed in applicable statutes.

V. Records Maintained

A. Categories of Materials Subject to Record-Keeping

Marketing and Advertising Materials: Visual depictions of actual or simulated sexually explicit conduct acquired or created by the Platform operator to promote the Platform
Non-Exempt Materials: Any visual depictions that do not qualify for exemptions described in Section IV

B. Required Record Elements for Each Performer

For each performer appearing in visual depictions subject to 18 U.S.C. § 2257, the following records are maintained:

C. Record Separation

PERFORMER RECORDS ARE KEPT SEPARATE FROM ALL OTHER RECORDS to ensure confidentiality and compliance with privacy requirements.

VI. Platform Operator Status

A. Third-Party User Content

The Platform's operator is not the “producer” (as defined in 18 U.S.C. § 2257) of any depictions created by third-party users. The Platform limits its handling of content to:

Transmission
Storage
Retrieval
Hosting
Formatting

Under 18 U.S.C. § 2257(h)(2)(B)(v) and 47 U.S.C. § 230(c), the Platform operator may delete materials considered indecent, obscene, defamatory, or inconsistent with Platform policies.

B. Platform-Produced Content

For any image or video where the operator may be considered “producer,” the exemptions of Section IV apply.

VII. Age Verification Protocols

The Platform implements strict age verification protocols:

Pre-Production Verification: All performers must provide valid government-issued identification confirming 18+ before production
Document Verification: Two forms of identification required, including minimum one government-issued photo ID
Sworn Statements: Both performer and producer/photographer must execute sworn statements under penalty of perjury
Record Maintenance: All verification documents maintained by Custodian of Records
Regular Audits: Periodic review of age verification records to ensure continued compliance

VIII. International Operations

Fansxity operates internationally with legal domicile in Río Cuarto, Córdoba, Argentina. This Compliance Statement addresses the following jurisdictions:

Information contained in this Statement is accurate as of the date specified above
All performers appearing in visual depictions of sexually explicit conduct were at least 18 years of age at time of production
Records are subject to inspection by authorized government officials
Platform complies with all applicable record-keeping requirements
